You get a random letter by someone incarcerated, alleging that they are innocent. It's troubling. You're a lawyer. You would like to make an inquiry, and maybe even take the case pro-bono. But how? Is there a way to assess innocence claims? How should evidence used to convict be evaluated? No one wants to be overwhelmed with reams of legal documents- what materials should be gathered? What are the potential paths to exoneration? This CLE will equip all lawyers, regardless of practice area, to assess innocence claims and viability of exoneration. Instruction will be given in an easy to understand, how-to manner. Red flags surrounding faulty evidence will be reviewed, as well as investigative lines that have previously led to exoneration. Jeffrey Deskovic, exoneree turned attorney, and founder of The Jeffrey Deskovic Foundation for Justice, which has freed 15 people and helped pass 9 laws, shares his insights into the process, based on: 14 yrs at The Foundation; structural knowledge of wrongful convictions; informal learning; and his own case.
